COURTING SUCCESS

If anyone is looking for entertainment tomorrow, there would be worse places for an IP lawyer to go to than the Royal Courts of Justice:

*In Court 75, judges (including Lord Justice Jacob) will be delivering the Court of Appeal’s judgment in William Hill v British Horseracing Board, a database decision that has been to the ECJ.

*Also in Court 75, Lord Justice Jacob will be hearing the next stage of Hormel Foods Corporation v Antilles Landscape Investments N.V. (the Spam infringement/invalidity case). This time the parties are seeking permission to amend the appellant’s notice and for the defendant to cross-appeal.

*In Court 70, the Court of Appeal (including Lord Justice Neuberger) will be delivering its final decision in La Mer v Goemar, a case on what counts as genuine use as a trade mark that was given short shrift by the ECJ.
The IPKat will use best endeavours to report these judgments to you, as and when they become available to him.

All comments must be moderated by a member of the IPKat team before they appear on the blog. Comments will not be allowed if the contravene the IPKat policy that readers' comments should not be obscene or defamatory; they should not consist of ad hominem attacks on members of the blog team or other comment-posters and they should make a constructive contribution to the discussion of the post on which they purport to comment.

It is also the IPKat policy that comments should not be made completely anonymously, and users should use a consistent name or pseudonym (which should not itself be defamatory or obscene, or that of another real person), either in the "identity" field, or at the beginning of the comment. Current practice is to, however, allow a limited number of comments that contravene this policy, provided that the comment has a high degree of relevance and the comment chain does not become too difficult to follow.
